BOOKING CONDITIONS 2022

 

 

 

1.         The property known as Cravate aux Papillons, 490 Chemin du Ransou, Quartier St. Clement,, 83680 La Garde Freinet, France [“the property”] is offered for holiday rental subject to confirmation by Jobyna and Paul Burnand [“the owners”] to the renter [“the client”].

 

 

 

2.         Clients wishing to rent the property will be sent a copy of the booking terms and conditions with the request that they pay 25% of the total rental due to confirm the booking. Payment of the deposit  will constitute the formal acceptance of the booking and the terms and conditions.

 

 

 

3.         The balance of the rental charge together with the damage deposit (See clause 4) are payable not less than 8 weeks before the commencement of the rental period.  If payment is not received by the due date the Owners reserve the right to give notice in writing that the reservation is cancelled.  The Client will remain liable to pay the balance of the rent unless the Owners are able to re-let the Property.  In this event, clause 5 of these booking conditions will apply.  Reservations made within eight (8) weeks of the start of the rental period require full payment at the time of the booking

 

 

 

4.         Deposits. A refundable Damage Deposit of €300 or such other sum as agreed is required in case of damage to the Property or its contents.  However, the sum reserved by this clause shall not limit the Client's liability to the Owners. The Owners will account to the Client for the Damage Deposit and refund the balance due after the end of the rental period.

 

 

 

5.         Subject to clauses 2 & 3 above, in the event of a cancellation by the Client, refunds of amounts paid will be made only if the Owners are able to re-let the Property. Any expenses or losses incurred in so doing will be deducted from the refundable amount.

If the Owners cancel a reservation a full refund of any deposit or rental will be paid to the Client within one week of the cancellation. This does not apply in the case described in clause 3.

 

            The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and have full cover for the party's personal belongings, public liability etc., since these are not covered by the Owners' insurance.

 

 

 

6.         The start and end date of the rental will be agreed with the Owmers at the time of the booking. The rental period shall commence at 4.00pm on the first day and finish at 10.00am on the last day.  The Owners shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated. 

 

 

 

 

7.         The maximum number to reside in the Property shall not exceed seven (7) unless the Owners have given written permission.

 

 

 

8.         The Client agrees to be a considerate tenant and to take good care of the Property and to leave it in a clean and tidy condition at the end of the rental period. The Owners reserve the right to make retention from the Damage Deposit to cover additional cleaning costs if the Client leaves the Property in an unacceptable condition.  The Client also agrees not to act in any way which would cause disturbance to those resident in neighbouring properties.

 

 

 

9.         The Client shall report to the Owners' agent without delay any defects in the Property or breakdown in the equipment, plant, machinery or other appliances in the Property, garden or swimming pool and arrangements for repair and/or replacement will be made as soon as possible.

 

 

 

10.       The Owners shall not be liable to the Client:

 

            A. For any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the Property, garden or swimming pool.

 

            B. For any loss, damage or injury, which is the result of adverse weather conditions, riot, war, fires, strikes or other matters beyond the control of the Owners.

 

            C. For any loss, damage or inconvenience caused to or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owners shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.

 

 

 

11.       Under no circumstances shall the Owners' liability to the Client exceed the amount paid to the Owners for the rental period.

 

 

 

12.       The Client agrees to make good any minor breakages or losses before departure.

 

 

 

This contract shall be signed by both the Owners and Client and governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England.  Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England.
