The property known as Le Puits Marteau, Brie sous Mortagne ("the property") is offered for the holiday subject to confirmation by Gary and Kate White ("the owners").

Conditions of hire:- The hiring contract shall be between the Hirer and the Owners of the property for which the booking is made and shall be deemed to be made subject to these conditions of hire. The contract of hire is not effective until the Owners dispatch to the Hirer written confirmation of a booking.

Payment:- Bookings will be confirmed by the Owners on receipt of the appropriate initial payment as detailed on the booking form. At this time a booking confirmation will be issued, incorporating the cost of accommodation rental and breakage deposit less the initial payment made. The outstanding balance is payable to the owners not less than twelve weeks before the commencement of the holiday.

Cancellation:- If payment is not received by the due date, the Owners reserve the right to give notice in writing that the reservation is cancelled. The Hirer will remain liable to pay the balance of rent unless the Owners are able to re-let the Property. If the Owners are successful in re-letting the holiday then the deposit will be refunded less the greater of either the cost incurred in re-letting the property or an administrative charge of £30. These conditions will apply to cancellations within eight weeks of the holiday commencement date so long as the Owners have been successful in re-letting the holiday. For holidays not re-let, Hirers will automatically lose their deposit and will also be liable to pay the remaining balance of the accommodation rental. In all other aspects the Owners will hold the Hirer responsible only to the extent the he/she incurs a financial liability.

Duration of Holiday:-The rental period shall commence at 4.00p.m. on the first day and finish at 10.00a.m. on the last day. The Owners shall not be obliged to offer the accommodation before the time stated and the hirer shall not be entitled to remain in the occupation after the time stated. Bedrooms need to be vacated by 08.30a.m. so that cleaners can start.

Hirers Responsibility:-The Hirer is responsible under French law for the property and its contents whilst on holiday. The Hirer is also responsible for leaving the property in a clean and tidy condition.

Breakage Deposit:-A refundable breakage deposit of £500 per holiday will be included in the booking confirmation and is payable not less than 16 weeks before commencement of the holiday. The breakage deposit will normally be refunded to the Hirer within four weeks of the end of the holiday. If there are any breakages or more than reasonable cleaning requirements then the Owners reserve the right to deduct these costs from the breakage deposit . Additionally, if there are any charges in excess of the breakage deposit then the Hirer will reimburse the Owners accordingly. The Hirer also agrees not to act in any way which would cause disturbance to those residents in neighbouring properties.

Travel Insurance:-The owners recommend that personal Travel and Cancellation Insurance is obtained by the Hirer and to have full cover for the party's personal belongings, public liability etc. as these are not covered by the Owners insurance. Proof of cover will be needed.

Gas and Electricity:-All gas and electricity for domestic consumption is included in the cost of the holiday.

Amenities:-The use of accommodation and amenities is entirely at the user's risk and no responsibility can be accepted for injury and loss or damage to the user's or visitor's belongings. The Owners shall not be responsible to the Hirer for any temporary defect or stoppage in the supply of Public Services to the Property, nor in the respect of equipment, plant, machinery or appliances in the Property or garden. The Owners shall not be responsible for any loss, damage or injury which is as a result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owners or for any loss, damage or inconvenience caused or suffered by the Hirer of the property in the event that the Property, equipment, plant, machinery or appliances shall be destroyed or substantially damaged before the start of the rental period and in any event, the Owner shall, within seven days of notification to the Hirer, refund to the Hirer all sums previously paid in respect of the rental period, ie. deposit.

Personal Belongings:-Baggage and personal belongings are at the Hirers risk at all times.

Motor Vehicles:-No responsibility can be accepted for the loss or damage to any vehicle or its contents.

Party size:-In no circumstances may more than the maximum number of people stated in the details be exceeded except by prior written agreement with the Owners. The Owners reserve the right to refuse admittance if this condition is not observed.

Complaints:-If during the course of the holiday the Hirer has any reason for complaint he/she should contact the Owners as soon as possible in order that immediate action may be taken.

This contract shall be governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England.

Note: It is advisable to arrange insurance against cancellation of your holiday.
