LINEN AND TOWELS: Bed linen, bathroom towels and kitchen towels are included in the rental price.

 

HOUSE CLEANING: An end of stay cleaning service fee of 200 Euros will be deducted from your security deposit if the house is not left in clean condition.

 

CANCELLATION FEES: Cancellations made 8 weeks or more from the start of the rental period are fully refundable, less a 100 Euro administration fee. Cancellations made less than 8 weeks in advance of the rental period are no longer refundable unless we are able to re-let the property.

 

Please remember this is a NO SMOKING PROPERTY and NO PETS ARE ALLOWED (members of our family have allergies and asthma).

 

BOOKING CONDITIONS 

 

1.          The property known as Mont Joie (“the Property”) is offered for holiday rental by (“the Owner”) to the renter (“the Client”).

 

2.          To reserve the Property, the Client should complete and sign the booking form and return it together with payment of the initial deposit (25% of the total rent due).  This deposit is fully refundable, less a 100 Euro administration fee, up to 8 weeks before the rental period. Cancellations made within 8 weeks are not refundable unless we are able to re-let the property.  Following receipt of the booking form the Owner will send booking confirmation.

 

3.          The balance of the rental together with the security deposit (see clause 4) is payable not less than 4 weeks before the start of the rental period.  If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled. Reservations made within four weeks of the start of the rental period require full payment at the time of booking.

 

4.          A security deposit of €500 is required in case of, for example, damage to the property or its contents.  However, the sum reserved by this clause shall not limit the Client’s liability to the Owner.  The Owner will account to the Client for the security deposit and refund the balance due within two weeks of the rental period, providing no damage has occurred.

 

Subject to clause 2 and 3 above, in the event of cancellation.  The client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover and to have full cover for the party’s personal belongings, public liability etc.  since these are not covered by the Owner’s insurance and are not the Owner’s responsibility.

 

You are also advised to arrange health and accident cover for yourself and your party.

 

5.          The client shall leave the Property in a Clean Condition at the conclusion of the Rental Period.  A Clean Condition is defined as leaving all furniture, dishes, utensils, pots, pans, appliances and other household items in a clean, orderly and tidy manner; leaving all kitchen surfaces, kitchen appliances, countertops, kitchen cabinets, tile and wood floors, in a clean condition, interior of the refrigerator and freezer emptied and cleaned, all furniture replaced to its original arrangements, and all trash properly disposed of in the Beynac municipal dumpsters and recycle bins.   Failure to leave Property in a Clean condition, including but not limited to any appliances left in an unclean condition, and/or any unwashed dishes and other refuse left on the Property after the Rental Period may result in a surcharge of €200.

 

6.          The rental period shall commence at 4.00 p.m. on the first day and finish at 10.00 a.m. on the last day.  The Owner shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated.

 

7.          The maximum number of guests using the Property must not exceed 6 unless the owner has given written permission. There will be a surcharge of €500, if more than 6 people are found to be sleeping at the house without the owner’s written permission.

 

8.          The Client agrees to be a considerate tenant and to take good care of the Property and to leave it in a tidy condition at the end of the rental period, ready for it to be cleaned by the caretaker.  The Client also agrees to act in a lawful manner and not take part in any illegal or criminal activity or act in any way that would cause disturbance to those resident in neighbouring properties.

 

9.          The Client shall report to the Owner’s agent without delay any defects in the Property or breakdown of the equipment, or appliances in the Property, and arrangements for repair and/or replacement will be made as soon as possible.

 

10.        All appliances, including electrical and gas appliances, must be used to the correct manufacturer’s instructions.  The Owner cannot be held responsible for the misuse of any appliance.  Children under the age of 16 years must not use any electrical, gas or similar dangerous appliance.

 

11.        The Client cannot hold the Owner responsible for vehicles owned/rented while they are parked in the Beynac parking lots or the private parking grotto. If you choose not to use the private parking grotto, we suggest you visit the Mayors Office upon your arrival and purchase a parking pass for 12 Euros that allows you to park in your choice of two lots. You may ask our agent onsite to assist you. At certain times of the year parking permits are not enforced.

 

12.        The Client must ensure that the property is securely locked (all exterior doors and windows) when they are away from the property at any time.

 

13.        The Owner shall not be liable to the Client:

·   For any temporary defect or stoppage in the supply of public services to the Property, nor in the respect of any equipment, plant, machinery of appliance in the Property.

·   For any loss, damage, inconvenience or injury that is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner.

·   For any loss, damage or inconvenience caused to or suffered by the Client if the property shall by destroyed or substantially damaged before the start of the rental period and in any such event, the Owner shall, with seven days of notification to the Client, refund the Client all sums previously paid in respect of the rental period.

 

14.        Under no circumstances shall the Owner’s liability to the Client exceed the amount paid to the Owner for the rental period. By executing below Client hereby agrees that Client and Client’s Permitted Invitees will not pursue any legal action against Owner for any loss, accident, expense, damage, claim, warranty, injury or similar loss caused or incurred as a result of Client’s use of the Property or arising out of any condition on the Property.  Client further agrees to indemnify and hold Owner harmless from any claim or demand, made by any third party due to or arising out of Client or Client’s Permitted Invitees’ use of the Property or any violation of this Agreement by Client or Client’s Permitted Invitees. In addition, Owner shall not be responsible for loss of money, jewelry or valuables of any kind on the Property.

 

15.        This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to the principles of conflicts of laws.  By executing this Agreement, Client and Client’s Permitted Invitees agree to submit to the exclusive jurisdiction of and agree to the venue of the courts of the State of Utah, whether state courts or federal courts or federal courts located in the State of Utah. Client and Client’s Permitted Invitees hereto agree not to bring an action in any court of law located outside the State of Utah.
