The following Conditions together with information providedon websites advertising the property for rental form the basisof your agreement for your rental of the above property.Nothing in these conditions affects your normal statutory rightsunder Law. In these conditions ‘you’ and ‘your’ means the firstperson or persons on the booking (and any other personsubstituted at a later date) the party ‘leader’ and all othermembers of the holiday party. References to ‘your holiday’means the property rental and servicesYour BookingTo book the property you must be over 18 years of age, andbook it on the relevant websites. When you receiveconfirmation that your booking deposit has been received, youhave now entered into a contract with Mr and Mrs Smith. Theowner and their representative have the right to refuse anybooking prior to receipt of the deposit, any monies received ifdeemed necessary will be refunded. You must check theconfirmation details and if there is anything incorrect; you mustinform the Owner or representative immediately by email.Special requests must be made at the time of booking. Failureto meet special requests will not be a breach of contract.Conditional bookings will not be accepted unless specificallyagreed by email with the owner.PaymentIf booking is made 8 weeks or less before start date, fullamount is due at time of booking; otherwise a deposit of 25% isdue upon booking and balance 8 weeks prior to rental startdate, or booking will be deemed as cancelled. All payments tobe made in sterling. The owner will, on receipt of monies, emailconfirmation and details of your booking and date of balancedue.Cancellation by the OwnerThe Owner does not expect to make a cancellation or changesto your booking. Should a problem occur, that requires websitedescription altered, or it becomes necessary to make acancellation, the Owner reserves the right to do so. Should thishappen the Owner or their Representative will contact theparty leader by email or by telephone if possible. All moniespaid by you will be refunded or transferred to another rentalperiod if acceptable to you. No further compensation or liabilityfor any consequential loss or damages will be made by theRepresentative or the Owner.Cancellation by YouIf your booking is changed or cancelled more than 8 weeksprior to start date of your booking, the 25% deposit will beforfeited ( unless other arrangements have been agreed withthe Owner). Any cancellation made to your booking between56 days and 42 days prior to the start of your rental period,60% of the total amount will be forfeited. Cancellations made41 days to 29 days prior to start date of your rental period, 85%of the full amount will be forfeited. Cancellations to yourbooking made 29 days prior to start date of your rental periodwill not be refunded, unless the property can be relet for thesame amount or higher. In such a case, an administrationcharge of £100 will be retained. We advise you to take suitableholiday insurance which will compensate you in anycircumstances.Noise/NuisanceCruzy is a working village, and while we cannot guarantee thatyour neighbours will be quiet during the day, we would requestthat you respect your neighbours need for peace and quietafter 10 pm.Arrival and DepartureOn the day of arrival, entry to the property is from 4pm.On theday of departure, please ensure that the property is vacated by10am.Times of arrival and departure may be changed onrequest at the Owners discretion. Should you fail to arrive bynoon of the day after your arrival date, and not notified theRepresentative; the booking will be treated as a cancellation.Breakages and Damage to propertyDuring your rental period you are responsible for anybreakages, damage to the property and contents, caused byyourself or any member of your party. You will be liable to payfor repair including all costs or replacement. Please inform theOwner/Representative as soon as possible. A breakage depositof £500 is required (refundable one week after your departureif no charges are incurred) before your arrival when makingfinal payment.OccupationYou must not, unless it has previously been agreed with theOwner/Representative, allow more people than the websitespecifies (8 persons) to occupy the property or change thecomposition of your party during your stay. The property is notto be used for a commercial purpose or sublet or assign toanyone not accepted by the Owners. If you do any of thesethings in the opinion of the owners representative or misusethe property, the Representative can repossess or refuseadmission to the property. In this situation it will be deemed asa cancellation by you, no refund of any monies will be madeand the Representative will have no liability to you whatsoever( this includes providing alternative accommodation and/orcost associated with this).Health & Safety and Swimming poolThe property has smoke detectors. The Representative shouldbe informed immediately should there be a fault in anyequipment on the premises. The Owner/Representative do notaccept any liability for any injury or harm caused by negligenceof any member of the party. The party leader and guests areresponsible for the health and safety by taking due diligenceand practising such measures as necessary for own wellbeingand safety. You are expected and advised to take out full andadequate personal health/accident/holiday insurance beforeyour stay. As glass is not to be used by the pool; There areplastic plates, bowls, cups and a selection of cups/tumblers andwineglasses for use by the pool. The swimming pool isequipped with an alarm. There is a safety fence to protect thepool and garden area which can be erected on request as well. Children are welcome at the villa but due to the unfamiliar layout, stairs and open pool, young children should be supervised at all times. Due to the shape of staircases in the house, there are no child gates available.The party leader is responsible for the security and safety of allmembers of the party and undertakes to ensure responsiblebehaviour in and around the pool at all times.Cleaning and MaintenanceYou are responsible for all cleaning and maintenance of theproperty during your stay, leaving the property clean and tidyand in a reasonable condition on departure. During your stayyou must let the Owner/Representative/Workman have accessto the property during reasonable times ( except in case of anemergency when immediate access is required. TheOwner/Representative may gain entry if you cannot becontacted in time).LawThis contract is subject to English law and it is agreed that anydispute, which may arise between the parties will be dealt withby the courts of England and Wales.

     

Note: It is advisable to arrange insurance against cancellation of your holiday.
